Terms and Conditions for Real Estate

a) The property shall be sold to the highest bidder regardless of price at unreserved public auction.

b) The purchaser shall execute an Agreement of Purchase and Sale, provided by Re Max Real Estate Central AB., without modification, immediately after being declared the highest bidder.

c) The purchaser shall accept the property in an as-is condition as of closing date and the purchaser specifically agrees that the Seller, Auctioneer or Re Max Real Estate Central AB. (Ponoka) does not makes any representations or warranties of any kind whatsoever, expressed or implied, to the purchaser as to the condition or fitness of the property, environmental or otherwise, or any improvements thereon. All descriptions, measurements and acreage provided by the Seller and the Auctioneer are meant as a guide only. The purchaser shall have satisfied himself as to the location and condition of the property and all descriptions with respect thereto, prior to bidding.

d) Re Max Real Estate Central AB. (Ponoka) is acting as an agent of the seller only. Not the purchaser.

e) This is a cash sale and not contingent on the purchaser’s ability to obtain financing.

f) The purchaser shall submit a NON-REFUNDABLE deposit to Re Max Real Estate Central AB. (Ponoka) in the form of a certified cheque, money order or bank draft, in the amount of ($5,000.00) five Thousand Dollars, Per Lot, immediately after being declared the highest bidder. The balance of the purchase price shall be paid at or before the closing.

g) All deposit earnest and purchase monies in respect to the property shall be paid to and deposited with Re Max Real Estate Central AB. (Ponoka)

h) No personal property shall be conveyed with the property unless specifically included in the purchase agreement.

i) Applicable Federal or Provincial taxes must be paid by the purchaser in addition to the purchase price.

j) Completion and closing of all real estate transactions will be handled by Re Max Real Estate Central AB. (Ponoka)   Closing will take place on the date that is 30 days after the date of the auction or such other date as may be mutually agreed upon by both the seller and the purchaser.

k) The purchaser will receive vacant possession on the date of closing.   

l) The buyer must register with Sekura Auctions Ltd. On or before 6:00 pm, Tuesday April 20^th, 2010.

m) Architectural restrictions do apply to this property and it is the responsibility of the buyer to be informed of them.

n) A 5% ( five percent) buyers fee applies to all real estate purchases.
